Application of Jane Doe, Everyroad, Ennis, Co. Clare for outline permission for 1 dwelling house only and septic tank on site no. 1 at Kilvoydane South, Spancilhill, Co. Clare

An outline permission has been granted for the development described above subject to the following 15 conditions.

  1. The development of 1 no. dwelling house only, on Site no.1, shall be carried out hi accordance with plans and particulars submitted to the Planning Authority on 26th September 2002 as amended by plans and particulars submitted on 03rd December 2001, 8th February 2002 and 19th April, 2002 and the terms of the Section 38 Agreement and the particulars submitted on 19th April, 2002 except where altered or amended by conditions in this permission.
  2. The existing road boundary shall be retained in its entirety except where its removal is required for the construction of an entrance to serve the dwelling and for a minimum distance of 5m on both sides of the entrance. 1. 1 m high side walls and piers of proposed entrance and any new roadside boundary shall be constructed of natural stone or sod and stone and shall be tied into the existing roadside boundary, all to the satisfaction of the Planning Authority. . The area between the new wall and the edge of the road carriageway shall be excavated over, filled with a compacted granular material brought to road level with the existing camber continued, drained, sealed and left suitable for parking. To facilitate agreement and approval on this, full details shall be submitted to the Planning Authority.
  3. The entrance gate shall be recessed 15 ft. inside the line of the road boundary wall, with wing walls not more than 3'6" in height splayed at an angle of 45 degrees or bellmouthed in a manner to give an entrance width of 45 ft. at the new fenceline.
  4. Concrete pipes shall be provided in the bed of any existing roadside drain where that drain is located under the proposed entrance and the parking area specified at 2 above. These pipes shall be of a capacity and shall be laid in a manner to ensure the continued free flow of water and the avoidance of flooding. The drain bed shall be graded to permit the continued free flow of water and the piped length shall be backfilled and consolidated in a manner adequate to accommodate the parking of vehicles.
  5. The access way shall be level with the nearer edge of the roadway. The access gradient from the fence line to the development shall not exceed 1 in 20 for a distance of 10 metres.
  6. Surface water from site shall be prevented from running onto surface of public road by provision of a safety kerb or a concrete grid with sump drained to local drain or soakaway.
  7. Adequate provision shall be made for drainage of surface water from public road by the provision and maintenance of a safety kerb or a concrete grid with sump drained to local drain or soakaway.
  8. All surface water run-off from roofs, entrances and parking areas shall be collected and disposed of within the site to soakpits/adjacent watercourses. It shall not be discharged to septic tank or percolation area or future public sewer.
  9. The roof of the proposed structure shall be dark brown, dark grey, bluelblack or other colour approved by the Planning Authority.
  10. Existing hedgerows, trees and shrubs on site shall be preserved, save where their removal is required by other conditions of this permission. The site shall be landscaped in accordance with a comprehensive landscaping scheme which shall include the following:

    (i) proposals for the protection and retention of existing on site trees, hedgerows, field boundaries and other natural features;

    (ii) proposals for additional planting of native or naturalised species in informal clusters;

    - and full details of the scheme, including an annotated site layout drawing and schedule showing species, numbers, and locations of existing and proposed planting, together with a programme for its implementation. shall be submitted to and agreed with the Planning Authority before development commences.

  11. All service lines and cables servicing the proposed development shall be located underground except where otherwise agreed with the Planning Authority.
  12. The proposed septic tank and percolation area shall be constructed in accordance with S.R.6 of the N.S.A.I. or other such plan as may be agreed with the Council and shall be located not less than 20m from any dwelling house, not less than 10m from any road boundary, strewn or ditch, not less than 3m from any other boundary of the site and in a position which will not cause contamination of any source of potable water but in any case not less than 30m from any such source.
  13. No development shall commence on the house construction until the Council is satisfied that the proposed well can provide an adequate supply for the house with respect to water quality and quantity. To this effect the results of yield, chemical and bacteriological tests on the well shall be lodged for the agreement of the Council before any house construction commences.
  14. The location of the dwelling on site shall be subject to the agreement of the Planning Authority at Approval.
  15. The design of the dwelling shall be traditional in form, massing and bulk. The architectural standard, finishes and materials of the dwellings shall be submitted for the agreement of the Planning Authority at Approval.
